DAVID KAU, a well-known filmmaker, actor and comedian, is in a spot of bother with his house.

According to the bank, he hasn’t serviced his house payment for 11 months and the institution wants him to pay up.

The bank is gunning for his Kyalami house in Joburg after he allegedly defaulted on the payment agreement.

It has gone to the South Gauteng High Court to obtain a judgment against Kau, and an attachment order for his house to be auctioned.

In the court papers seen by Daily Sun, the bank is seeking judgment against him for payment of the amount of R1 398 651,35.

“The bank is authorised to issue writs of attachment calling upon the sheriff of the court to attach the property and sell it in execution,” read the document.

A reserve price would be set for R1,9 million. Court papers also stated that the bank wanted Kau to pay costs.

In the founding affidavit, the bank’s recoveries manager said Kau first defaulted on payment last May.

“The first responded continued default and as of 25 January, he was and remains in arrears in an amount of R275 847,83.”

The bank said its only real prospect of recovering the outstanding amount was through auction.

“The applicant believes that the judgment debt will never be satisfied,” said the bank.

Kau said he was not aware of any intention of putting his house under the hammer.

“I am taking FNB to the Ombudsman. As far as I know, it has sent lawyers, and my lawyers have responded. I don’t know anything about attaching my house.”

Kau referred Daily Sun to his lawyers at G Nkomo Incorporated, where Gcobisa Nkomo said they had not received any court papers.

“We know nothing about that.”

She said that FNB did write to Kau at the beginning of the year, and he went to his lawyer.

“We spoke to him and wrote the letter to FNB attorneys, and told them we were approaching the Ombudsman,” she said, adding that it was shocking that there were court papers while they were not aware.

“Actually, the liability is disputed on the basis of the house. It is a story we are going to table with the Ombudsman. We are of the view that the house should not be auctioned.”

Kau has produced films such as Blitz PatrollieTaxi Ride and Room Divider through his production company. He is also the founder of Blacks Only comedy show, that has had a lot of success over the years.

FNB’s Tsietsi Mahlasela said: “Due to client confidentiality, FNB cannot provide any information on specific bank accounts.”
